Terms of Sale
Bronze Sculptures & Busts — Custom and Made-to-Order Work
1. Who We Are
These Terms of Sale ("Terms") govern all purchases made through ateliermissor.com (the "Site"), operated by Atelier Missor Inc., a Delaware corporation, with its principal mailing address at 501 Silverside Road, Suite 149, Wilmington, DE 19809, and its studio located at 5259 Bane Road NE, Mechanicstown, OH 44651 ("Atelier Missor," "we," "us"). By placing an order on the Site, you ("Customer," "you") agree to these Terms.
2. Products
Atelier Missor sells bronze busts and sculptural pieces, produced using casting and hand-finishing techniques. Because each piece is cast and finished by hand, minor variations in patina, texture, and finish between the product photographs and the delivered piece are normal and do not constitute a defect.
3. Made-to-Order Production
Unless a piece is explicitly listed as "in stock" or "ready to ship," all bronze busts are produced to order after payment is received. Production begins once your order is confirmed and payment has cleared.
4. Pricing and Payment
All prices are listed in US Dollars (USD) and are exclusive of applicable sales tax, which is calculated and added at checkout based on the shipping destination. For orders shipped outside the United States, shipping is calculated and added at checkout; import duties and taxes are not included and are payable by the Customer to the carrier or customs authority on delivery. Payment is processed securely through Stripe at the time of order. We do not store your payment card details.
5. Estimated Delivery Time
Made-to-order bronze pieces typically require 3 months from order confirmation to shipment, depending on the size and complexity of the piece. This is an estimate, not a guaranteed date; we will notify you of any significant delay. Delivery times exclude shipping transit time (see Section 7).
6. Order Changes and Cancellations
Because production begins promptly after payment, orders may be modified or canceled free of charge only within 24 hours of order confirmation. After that window, cancellation may only be offered at our discretion and may be subject to a fee reflecting materials and labor already committed.
7. Shipping and Risk of Loss
Bronze pieces are professionally packed and shipped via insured freight or courier appropriate to the size and weight of the piece. Shipping costs and estimated transit times are provided at checkout. Domestic orders within the United States ship free. International orders are shipped delivered at place (DAP): we arrange carriage to the destination, but import duties, taxes, and any customs or brokerage fees are the Customer's responsibility and are payable on delivery. Large or monumental pieces may require a separate shipping quote. Risk of loss or damage passes to the Customer upon delivery to the carrier; however, we will assist with any carrier insurance claim for damage in transit.
8. Returns and Refunds
Because each bronze piece is custom-made to order, all sales are final once production has begun, and we do not accept returns for reasons of personal preference (e.g., size, color, or subjective satisfaction with an inherently hand-made object).
The only exceptions are:
- The piece arrives materially different from what was ordered (wrong subject, size, or edition), or
- The piece arrives damaged in transit.
In either case, contact us at contact@ateliermissor.com within 7 days of delivery, with photographs, and we will arrange a repair, replacement, or refund at our discretion.
For international orders, import duties and taxes are paid by the Customer to the carrier or customs authority on delivery and are not collected or refunded by us. Where we issue a refund for an international order, the refund is limited to the price paid for the piece; shipping and any duties, taxes, or fees already paid are not refunded.
9. Warranty
Atelier Missor warrants that each bronze piece is free of manufacturing defects in the casting and finishing at the time of delivery. This warranty does not cover damage from improper handling, outdoor exposure not agreed to in advance, or normal patina evolution over time, which is characteristic of bronze.
10. Limitation of Liability
To the fullest extent permitted by law, Atelier Missor's total liability for any claim arising from a purchase is limited to the amount paid for the piece in question. We are not liable for indirect, incidental, or consequential damages.
11. Intellectual Property
All original sculptural designs remain the intellectual property of Atelier Missor Inc. unless otherwise agreed in writing (e.g., for commissioned monumental works governed by a separate agreement).
12. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law principles, without prejudice to any mandatory consumer-protection rights you may have under the law of your state of residence.
